I approached Farley Dwek for help in securing Continuing Health Care Funding for my husband who has advanced dementia. My first conversation with the solicitor was friendly and supportive. I was directed to extremely helpful free literature on their sister website and information on the services they offer and prices were emailed to me as well as a link to the free advice. No pressure was put on me to secure their services. Having been told by various health professionals that CHCF for dementia is particularly hard to secure and read the free information about the assessment process to secure funding I decided I wanted the additional support of a nurse to advocate for my husband. A sound investment! I had researched a number of firms offering assistance to help secure CHC funding for our Mum. I was very glad I chose Farley Dwek. Both my brother and I are retired solicitors and are able plough our way through regulatory material and legislation, However, neither of us had any experience in this area of law. I would recommend doing the initial screening exercise with one of their nurses, we had the excellent Diane Jenkins for screening (and eventual support at the MDT). Farley Dwek undertook my case against the NHS on behalf of my late Uncle to recover fees for his primary care, that were unjustly withheld and charged. My mother unfortunately had a very serious accident due to staff negligence in a store. Knowing from reports in the media that getting any reimbursement for Continuing Healthcare was a difficult process, and being told by the manager of Mum’s care home that she didn’t fit the criteria, we had no real hopes of a successful outcome. We engaged the services of Farley Dwek Solicitors to help with our claim for NHS Continuing Health Care (CHC) for my elderly mother. The NHS claim process is extremely complex and requires a thorough understanding of the NHS assessment criteria. A criteria that seems to be constantly changing.
We did contemplate acting for ourselves with the claim but thankfully we decided to engage Farley Dwek. The claim process is lengthy and requires complete scrutiny of medical records, care home records, examples of how mum’s diagnosis affected her behaviour and understanding and to present evidence of why mum is entitled to CHC in the correct format using the NHS decision formula. Throughout the claim process Farley Dwek were extremely professional, their understanding of the legalities of the NHS claim system was first class, in fact they seemed to have a better understanding of the rules than some of the NHS staff. Farley Dwek constantly kept up updated with the process of the claim. The claim was successful.
We next engaged Farley Dwek to reclaim the fees we had paid for care that should have been covered under CHC, again another lengthy and complex process but the claim was successful with 100% of the care home fees recovered. Farley Dwek also negotiated a payment for lost bank interest.

I contacted Farley Dwek regarding my mother in August 2014 after reading about them in the Daily Mail. I paid an initial fee for a nurse instructed by them to assess my mother to see if she was entitled to the CHC payment as she required constant care as she was paralysed down one side and could not swallow. Andrew Farley reviewed the assessment and agreed that it should have been granted and took her case on. The case was taken on a no win no fee basis so I felt confident in the advice being provided. It took 15 months to get a review date but unfortunately my mother died before a further assessment could be completed. The case progressed to a final appeal with NHS England and was successful in December 2021. I had never heard of your firm before but a friend also a solicitor had and had said you were good at what you did. I was lucky to get Ruth Pople. My initial chance introduction to Farley Dwek was seeing Andrew Farley being interviewed by Gloria Hunniford on morning TV. The interview referenced how an elderly person’s ailing health could be financially supported by the health service as opposed to self-funding. Regrettably after my father died, my mother’s health began to deteriorate and this was of considerable concern, then she was diagnosed with Alzheimer’s and following a couple of falls was admitted to hospital. However, after three months of hospitalisation, it was evident I would be faced with Hobson’s choice on her discharge! as it was essential for her to be nursed 24/7. This meant having to sell her much loved family home by the sea, in order to pay for her nursing home fees.
Several years later when funds were depleting, and realising mum’s health care needs outweighed her social needs, I contacted Farley Dwek for advice and support. Fortunately, having kept a chronological record of mum’s medical admissions to hospital and treatment whilst in the nursing home, I was able to relay the most salient points to Andrew Farley. Whilst being empathetic, he was extremely honest and clear with his advice and time scale relating to each stage of my case.
Prior to any decision being made concerning my mother receiving Continuing Health Care, a clinical report had to be submitted by an independent and qualified nurse. This clinical report would be taken into consideration and support me during the Continuing Health Care meeting with the Nursing Home staff, Social Services and a Senior Nurse Assessor (NEL Commissioning Support Unit). For those of us who are unfamiliar with the system it can be extremely daunting and that’s where Farley Dwek were a life line. Fortunately, my mother’s case was morally justified not only by Farley Dwek achieving CHC but also NHS Continuing Healthcare Previously Unassessed Period of Care (PUPoC).

Having paid £250K in care home fees, and despite the care home being negative about our chances of securing Continuing Healthcare funding, we approached Farley Dwek in February 2018 to get a clear understanding of our position.
We commissioned their review service and they were able to identify that we had a marginal chance at a claim; they were very measured in their approach and gave clear advice.
Subsequently we instigated a full review of my mother’s care. At this point their involvement was invaluable in identifying how the process should work and challenging the deficiencies of the CCG.
They represented us at a number of meetings, with their nurse assessors taking a very professional and informed approach.
We were surprised and delighted when the decision was made to approve funding.
